Thank you for choosing MK Driving School for your driving tuition in Newark on Trent. I very much look forward to instructing you through to test standard and hope you will find it an enjoyable and exciting experience.
Although learning to drive is an exciting time, it can also be equally daunting.
At MK Driving School, all of our instructors pride themselves on their ability to assess the level of confidence of each new driver, ensuring that your initial driving lessons are free from unnecessary anxiety. As your personal instructor, I’m here to help, and it’s my job to give you the confidence to get behind the wheel and pass your test.
However, there’s more to learning to drive than just knowing which pedal to put your foot on! Alongside your driving lessons, I’ll also help you grasp the theory test essentials to ensure you understand the rules of the road and can identify hazards that can make driving difficult.
Enclosed with this letter, you’ll find some useful information. There are many effective ways to prepare for your theory test, and we’ve included valuable tips and advice on the best methods to get started. You’ll also find that our website (mkdriving.net) is a valuable source of information.
As I am sure you will appreciate, to ensure you receive the best service from MK Driving School, it is also crucial that you understand the commitment being made by both yourself and us during your tuition. Therefore, we have included our Terms and Conditions, which we require you to sign and return to us. (If you are under the age of 18, the Terms and Conditions must be signed by your parents or guardian.) It’s important that this form is completed before your lessons commence.

This Terms & Conditions Agreement is a binding legal document. If you do not understand the nature of the agreement, it is recommended that you seek legal advice before signing.
**Cancellations during Covid-19**
If you or anyone in your household becomes unwell or shows symptoms of COVID-19, please inform your instructor ASAP. If your instructor experiences any of these symptoms, they will inform you and reschedule your lesson, ensuring safety during your driving lessons.
Should you or your instructor show symptoms during a lesson, the lesson will be terminated at no cost.
**Introduction**
The terms & conditions under which driving instruction is provided are outlined below. These terms are a contract between the client and the driving instructor & The Driving School. Any changes to these terms will always be communicated to the client in writing before implementation. These terms shall be construed under the laws and jurisdiction of the courts of England & Wales and do not affect your statutory rights.
**Code of Conduct**
The driving instructor and The Driving School adhere to a Professional Code of Conduct, copies of which are available upon request.
**Documentation**
Before or on the first driving lesson, you will be supplied with a copy of the ‘Terms & Conditions of Business’ of The Driving School, along with details of tuition fees, contact information, and access to our Total Drive App. You will be asked to either sign a copy of these terms or confirm via email that you agree to them.
**Entitlement to Drive**
You must hold a current, valid driving licence that entitles you to drive in the UK. You must also satisfy medical fitness requirements, including the ability to read a number plate at the prescribed distance. Your driving licence must be produced at your first lesson, and it will be checked periodically by your instructor. Any points, endorsements, or restrictions on your licence must be notified to MK Driving School immediately.
**Fitness to Drive**
It is your responsibility to ensure that you are fit to drive. Inform your instructor as soon as possible if there are any conditions that may affect your ability to drive or if you feel unwell before or during a lesson. Ensure you do not drive while under the influence of alcohol or drugs, and arrange lessons at times when you are not too tired or stressed. Appropriate footwear and clothing that do not restrict movement are essential. If glasses or contact lenses are required for driving, they must be worn at all times.
**Behaviour**
The driving instructor & MK Driving School do not tolerate verbal or physical abuse of any kind. Inappropriate behaviour may result in immediate lesson termination, and the lesson fee will be forfeited.
**Payments**
All lessons must be prepaid or paid at the start. Clients booking intensive driving courses—10 or more hours—will need to pay in full at least 14 days before the first lesson. Failure to comply will result in fee forfeiture. Payments may be made by cash or bank transfer.
If payments are in arrears, MK Driving School reserves the right to discontinue tuition until the account is updated. Any card transactions returned will incur a £25 charge.
**Lesson Fees**
You will receive information about tuition fees before or on your first lesson. Any alterations will be communicated promptly.
**Change of Driving Instructor**
MK Driving School aims for consistency by having one instructor conduct all your driving lessons. However, if a change is necessary, you may decline lessons from the replacement instructor without any responsibility for losses incurred.
**Change of Tuition Vehicle**
Tuition vehicles may change due to sales or mechanical issues. If a replacement vehicle is needed, we will give you as much notice as possible for familiarization.
**Postponements**
Lessons may be postponed due to unforeseen circumstances; a mutually agreeable alternative will be arranged. In all other cases, a minimum of 12 hours notice will be provided if appointment changes arise.
**Cancellation by Client**
Clients must provide at least 48 hours notice for lesson cancellations. Failure to do so will result in full lesson charges. Cancellation notifications should be directly communicated to your instructor or the office.
**Appointment Times**
To avoid missed lessons, clients should use the Total Drive App to track bookings. The instructor will wait 10 minutes before considering a lesson missed.
**Driving Tests**
All students must pass two mock driving tests the week before their scheduled DVSA practical driving test. Clients should first check their instructor's availability before booking a driving test and must notify their instructor of the details once booked.
**Cancelled Driving Tests**
If a driving test is cancelled due to our error, the next test fee will be covered by MK Driving School. However, we do not bear responsibility for cancellations by the DVSA.
**Refunds**
Clients paying in advance are entitled to refunds for unused lessons. If a discount was applied for upfront payment, only the balance after full lesson rates will be refunded.
**Supervision**
Occasionally, an observer may accompany a lesson to assess standards. Notice will generally be given in advance.
**Lessons in Client’s Own Car**
While most lessons are conducted in driving school cars, tuition in a client’s car may occur if the car is roadworthy and legally compliant, confirmed by the client’s insurance.
**Client’s Property**
Clients are responsible for their personal belongings during lessons, as we cannot accept liability for their loss or damage.
**Legal Liability**
Clients are legally accountable for any traffic violations while in charge of the vehicle.
**Complaints**
If you are unsatisfied with any aspect of your tuition, please raise your concerns with your instructor or MK Driving School within seven days of the issue. We strive to resolve any complaints satisfactorily.
Driving Licence Information:**
On your first lesson, you need to bring your provisional driving licence photo card and the summary of your provisional driving licence.
**How to Obtain Your Driving Licence Summary:**
To access your summary, generate a code or print a copy to present to your instructor. Failure to produce your summary will hinder you from driving due to insurance reasons.
